These Terms of Service ("Terms") are a contract between you and El Junto, Inc. ("El Junto," "we," "our," or "us"). They govern your use of the El Junto mobile application and the website located at www.eljunto.com (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference.

We may update these Terms from time to time. If we make material changes, we will notify users through the Services. Your continued use of the Services after changes are posted constitutes acceptance of the updated Terms.

1. User Rights and Responsibilities

A. Ownership of User Content

You retain ownership of all content you submit, post, or display through the Services ("User Content"). By posting User Content, you represent and warrant that:

1. You own the rights to the content, or
2. You have the necessary rights and permissions to publish it.

You are solely responsible for your User Content.

B. License You Grant to El Junto

By using the Services, you grant El Junto a non-exclusive, worldwide, royalty-free license to:

• host, store, reproduce, modify, publish, display, and distribute your User Content
• make your User Content available to other users in accordance with our Privacy Policy
• use your User Content in service-related communications, social media, and email distributions

This license exists solely to operate, improve, and promote the Services.

C. Content Moderation

We reserve the right to remove or restrict any User Content at any time and for any reason, including violations of these Terms or our community standards.

D. User Conduct

You agree not to engage in behavior that harms others or disrupts the Services. Prohibited conduct includes:

• harassment, bullying, stalking, or threats
• violating another user's privacy
• impersonation or misleading identity claims
• posting illegal content
• posting sexually explicit material
• posting malware, viruses, or harmful code
• commercial advertising or spam

Pseudonyms are allowed, but impersonation is not.

E. Reporting Violations

If you believe someone has posted content that infringes your rights or violates these Terms, use the in-app Report features. We will review the report and take appropriate action.

2. Age Requirement (18+ Only)

The Services are intended only for individuals 18 years of age or older. We do not knowingly allow minors to create accounts or participate in book clubs. If we learn that a user is under 18, we will terminate the account and delete associated data.

3. Use of the Services

A. Privacy and Data Collection

By using the Services, you agree that El Junto may collect and use your information as described in our Privacy Policy, including data collected through Microsoft Clarity, Microsoft Advertising, and other analytics tools.

B. Blocking

We allow users to block other users. When you block someone:

• They cannot follow you
• They cannot invite you to clubs they are a leader of
• They cannot request to join clubs you are a leader of

However, if you and a blocked user are members of the same book club, you may still see each other's posts or activity within that club. It is your responsibility to leave the club if you do not want any interaction with a blocked member.

C. Prohibited Technical Actions

You agree not to:

• hack, disrupt, or interfere with the Services
• attempt to access other users' personal information
• scrape, crawl, or harvest data
• reverse engineer the Services
• use or access our APIs without written permission

4. Disclaimer of Warranties

The Services are provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee:

• uninterrupted or error-free operation
• accuracy or reliability of content
• security of user-generated content

You use the Services at your own risk.

5. Limitation of Liability

To the fullest extent permitted by law, El Junto and its officers, employees, and affiliates are not liable for:

• any indirect, incidental, special, consequential, or punitive damages
• loss of data, profits, goodwill, or reputation
• damages resulting from interactions with other users, including club members
• damages resulting from unauthorized access, misuse, or disclosure of your User Content by other users

Your sole remedy for dissatisfaction with the Services is to stop using them.

6. Subscriptions and Payments

All subscription payments are processed exclusively through the app store you use (Apple App Store or Google Play). El Junto does not manage or control:

• billing
• refunds
• cancellations
• payment methods

It is your responsibility to manage your subscription through your app store account.

We are not liable for subscription issues, including failed cancellations or billing disputes.

7. Termination

We may suspend or terminate your account at any time for violations of these Terms or for any behavior that harms the community or the Services. You may stop using the Services at any time.

8. Changes to the Terms

We may update these Terms periodically. If changes are significant, we will notify users. Continued use of the Services after changes are posted constitutes acceptance of the updated Terms.
